LAST WILL AND TESTAMENT
I, CHARLES SWAIN of the town of Rushford, in the County of Allegany and State of New York, being of sound mind and memory, do make, publish and declare this my last WILL AND TESTAMENT, in the manner following that is to say:
FIRST: I direct that all of my just debts and funeral expenses be paid.
SECOND: I give and bequeath the sum of Five Hundred Dollars($500.00) to my son-in-law Irvin Lyman of Rushford, New York.
THIRD: All the rest, residue and remainder of my property both real and personal, that which I now own as well as that which I may hereafter acquire, I give, devise, and bequeath unto my children Leslie Swain, Ada Lee, Riley A. Swain, Frederick Swain, Delores S. Thurber, Dorothy S. Stroud, Joseph Swain, Mary S. Moore, and Charles Swain Jr., in equal shares.
LASTLY I hereby appoint my son Frederick Swain executor of this, my Last Will and Testament, with full power and authority to sell and convey, lease or mortgage real estate; hereby revoking all former wills by me made.
IN WITNESS THEREOF, I have hereunto subscribed my name the 16th of July in the year Nineteen Hundred and Fifty-nine.

We, whose names are hereto subscribed, DO CERTIFY that on the 16th day of July, 1959, CHARLES SWAIN the testator above named, subscribed his name to the instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing, declred the same to be his last WILL AND TESTAMENT, and requested us, and each of us, to sign our names thereto as witnesses to the execuation thereof, which we hereby do in the presence of the testator and of each other, on the day of the date of the said Will, and write opposite our names our respective places of residence.
